Please read these Terms carefully. By downloading, installing, or using the Thngs app or website, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.
These Terms of Use ("Terms") constitute a legally binding agreement between you and Thngs ("we," "us," or "our") governing your use of the Thngs mobile application and the website at urthngs.com (collectively, the "Service"). These Terms incorporate our Privacy Policy by reference.
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. For material changes, we will notify you by email or in-app notice. Continued use of the Service after any change constitutes acceptance of the updated Terms.
Thngs is designed to be a family-friendly platform appropriate for users of all ages. We strive to maintain a safe, welcoming environment that families can use and enjoy together.
You must be at least 13 years of age to create an account and use the Service independently. By using the Service, you represent and warrant that you meet this requirement. Children under the age of 13 may use the Service under the direct supervision of a parent or legal guardian who has agreed to these Terms on their behalf and accepts full responsibility for the child's use of the Service.
If you are between 13 and 18 years of age, we encourage you to use the Service with parental guidance. Your parent or legal guardian is welcome to participate in and oversee your use of the Service at any time.
The Service is intended for personal, non-commercial use unless otherwise agreed in writing with Thngs.
Certain features of the Service require you to create an account. You agree to:
We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, misused, or are in violation of these Terms.
Collections that you do not share remain stored exclusively on your device. We have no access to the contents of your private collections. You are solely responsible for maintaining backups of your private data. We are not liable for any loss of data resulting from device failure, app deletion, or any other cause.
The free tier is limited to 100 items across 3 collections. Paid tiers provide higher limits as described on our pricing page. We reserve the right to modify tier limits with reasonable notice.
When you choose to share a collection — whether publicly or privately with invited users — you are making that content available through our servers and, in the case of public collections, to all users of the Service. By sharing a collection, you represent and warrant that:
You retain ownership of content you create. By sharing a collection, you grant Thngs a limited, non-exclusive, royalty-free license to store, transmit, and display that content solely for the purpose of operating the Service. This license terminates when you revoke sharing or delete the collection.
All shared collections are subject to automated and, where flagged, human content review. Public collections are subject to more frequent and comprehensive review than privately shared collections. We reserve the right to remove any shared collection that we determine, in our sole discretion, violates these Terms or is otherwise harmful to users or the platform.
If your collection is flagged or removed, we will notify you where legally permissible. You may contact us to dispute a moderation decision at support@urthngs.com.
You agree not to use the Service to upload, share, transmit, or otherwise make available any content or engage in any conduct that:
Zero tolerance for illegal content. Any content that is illegal under applicable law — including but not limited to child sexual abuse material — will result in immediate account termination, permanent ban, preservation of evidence, and mandatory reporting to law enforcement authorities. We cooperate fully with all lawful law enforcement requests and investigations.
The Thngs name, logo, app design, and all associated software, text, graphics, and other materials are the exclusive property of Thngs and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of Thngs intellectual property to you.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works based on the Service or any part of it without our prior written consent.
Thngs offers optional paid subscription tiers. By subscribing you agree to pay all applicable fees as described at the time of purchase. All payments are processed through the Apple App Store and are subject to Apple's terms and refund policies. We do not directly process or store payment information.
Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time except where required by law.
We reserve the right to change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THNGS EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that any data stored through the Service will not be lost.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THNGS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Thngs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you share through the Service.
You may stop using the Service and delete your account at any time. Upon account deletion, your account data will be removed in accordance with our Privacy Policy.
We reserve the right to suspend or permanently terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any other reason we determine necessary to protect the Service or its users. Upon termination, your right to use the Service immediately ceases. Sections 7, 8, 10, 11, 12, and 15 survive termination.
The Service may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. We encourage you to review the terms and privacy policies of any third-party services you access.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
